이용약관 (Terms of Service)

These Terms of Service govern the access and use of the TriaView AI interview platform, associated services, and the website (collectively referred to as the 'Service') provided by Highable Consulting (hereinafter referred to as the 'Company').

Article 1 (Purpose)

The purpose of these Terms of Service is to define the rights, obligations, and liabilities between the Company and its Members (both Corporate Members who set up hiring processes and Applicant Members who take the interviews) when using the TriaView web platform, especially focusing on our credit billing and payment parameters.

Article 2 (Definitions)

1. Company: Refers to Highable Consulting, the developer and operator of 'TriaView', the AI video interview and evaluation platform.
2. Service: Refers to the suite of tools offered on the website, including AI assessment video streaming, competency evaluation models, PDF assessment reports downloading, and candidate dashboards.
3. Member: An individual or corporate entity who accepts these Terms, registers a secure profile, and accesses the features. Distinguished into 'Corporate Members' (recruiters) and 'Applicant Members' (candidates).
4. Credit: The digital units within the platform consumed to perform premium actions (e.g., publishing AI positions, analyzing applicant semantics, or generating structured PDF reports).

Article 3 (Validity and Amendment of the Terms)

1. These Terms become legally binding on the user immediately upon accepting them during the registration flow.
2. The Company reserves the right to modify these Terms in compliance with applicable local regulations. Amended terms will be announced on the system dashboard at least 7 days (or 30 days for significant changes affecting consumer rights) before their enforcement.
3. Continued use of the platform after the enforcement date of amended terms constitutes unconditional acceptance of the changes.

Article 4 (Formation of Service Agreement)

A binding service agreement is established when a user inputs accurate details into the registration forms, agrees to these Terms and the Privacy Policy, completes the signup process, and the Company approves the application. Social signups (like Google integrations) establish binding agreements in the same manner.

Article 5 (Service Credits and Payment Structure)

1. Welcome Credits Bonus: Upon successful registration as a new Corporate Member, the Company immediately grants a complimentary package of 60 Credits for testing.
2. Credit Consumption Metrics:
   • AI Job Creation: Automatically consumed when utilizing prompt wizards to generate structured job interview templates (Free Plan: 20 Credits / generation).
   • PDF Evaluation Reports: Deducted when exporting individual competency reports as PDFs (Free, Starter: 30 Credits / export).
   • New Job Opening Expense: Calculated dynamically based on the target applicant limit multiplied by the interview question length.
3. Refilling Credits and Subscriptions: Members can purchase credit packs or subscribe to tier plans (Starter, Business, Enterprise) in the 'Pricing' dashboard. Payments are securely processed through merchant-of-record gateways (such as Polar or other PG providers).

Article 6 (Company Obligations)

1. The Company will not engage in any activity prohibited by applicable laws or these Terms, and is dedicated to maintaining high-fidelity, secure, and reliable service availability.
2. The Company implements modern physical and technological security safeguards to protect user details, adhering to the standard Privacy Policy.
3. The Company will address any user grievances or bug reports raised on our channels without undue delay.

Article 7 (User Obligations)

1. Users must provide authentic, correct, and verifiable details during registration. Impersonating third parties or utilizing invalid email aliases is strictly forbidden.
2. Users must not violate intellectual property rights belonging to the Company or third parties, nor conduct malicious hacking activities (e.g. DDoS, unauthorized scraping).
3. Users are solely responsible for securing their account passwords, and bear all liabilities arising from security leaks due to personal negligence.

Article 8 (Disclaimers and Limitations of Liability)

1. The Company may temporarily suspend service operations for regular maintenance, servers upgrade, or network recovery, and will announce these disruptions in advance. Urgent updates may be communicated retroactively.
2. The Company is exempt from liability if the platform becomes unavailable due to force majeure events, including acts of God, war, severe cyber terrorism, or national utility outages.
3. The Company does NOT guarantee that the semantic evaluation algorithms or assessment metrics are 100% free of variance or reflect legally binding qualification criteria. The Company is exempt from liability regarding hiring disputes, human resource disputes, or losses incurred within the Member's internal organization due to platform utilization.

Article 9 (Governing Law and Jurisdiction)

1. Any disputes or legal proceedings arising from these Terms will be governed and interpreted under the laws of the Republic of Korea.
2. The parties agree that the competent courts in the Republic of Korea will hold exclusive jurisdiction, and the courts presiding over the Company's headquarters will act as the court of first instance.
